This Agreement grants the buyer i) the right to download, install and use this electronic publication, a SimonellielectronicBook, hereinafter referred to as SeBook, on the hard disk of one or more computers that are his/her exclusive property and do not form part of a network and ii) the right to make one back-up copy in case the original is lost or damaged. The back-up copy shall be a faithful copy of the original, including the copyright notice and the small print contained in the same. Under this agreement the buyer has also the right to print the text of the Sebook if such an option is available, but only for personal use.
LIMITATIONS ON THE LICENCE
Except for the above-mentioned cases, the buyer shall not execute or distribute any copies of the SeBook or transfer the relevant file from one computer to another belonging to a company or business network. The buyer shall not convert, decompose or in any other way modify the SeBook file and/or its text. The buyer shall neither lease the SeBook nor grant secondary licences concerning the same. The buyer shall not print multiple copies of the SeBook, nor shall he or she photocopy and/or market the same.
PROPERTY
Even though the buyer is the owner of the hardware and software where the SeBook has been downloaded, he or she shall not acquire the copyright in the same, as he or she, by purchasing it, is only granted a licence for personal use.
The property of the SeBook, including the relevant national and international copyright, remains exclusively vested in the publishers and/or its authors.
LIMITATIONS ON THE GUARANTEE
Each publisher guarantees the correct operation of their SeBooks provided they are downloaded correctly and viewed according to the hardware and software specifications that have been laid down. No other guarantee is provided in the event that the SeBook is used as a duplicate by any other person than the buyer and is marketed in violation of the terms of this Licence.
DISCLAIMER
No claim will lie for any matter arising from any SeBooks that have in any way been altered, from accidental damage, from damage caused by improper uses or from any irregularities due to any use different from that indicated in the specifications.
SCOPE OF THE AGREEMENT
The above sections - namely, Licence for Use, Limitations on the Licence, Property, Limitations on the Guarantee, Disclaimer - constitute the necessary basis for the conclusion of the present agreement.
GENERAL CLAUSE
The present agreement constitutes an inter partes contract with regard to its subject matter and is governed by the domestic law of the Italian State. The publishers will take legal action for any violation of the terms of the Licence for Use. It is agreed that the judicial authority of Milan, Italy has jurisdiction over any legal disputes.
